Terms of Use

The service

The App is a personal fitness companion for logging progress photos, body measurements, notes, and related information on your device. Features may include reminders, comparisons, and optional export or sharing when you explicitly choose to use them. The App is provided free of charge unless we notify you otherwise in the future.

The App stores information locally on your device. It is not a cloud backup service, medical service, or substitute for professional advice.

Not medical advice

The App is for general wellness and self-tracking only. It does not diagnose, treat, cure, or prevent any medical condition. Numbers, charts, and trends shown in the App are informational only. Always seek the advice of a qualified health professional with any questions about your health, nutrition, or exercise program.

Eligibility & acceptable use

You represent that you have the legal capacity to agree to these Terms where you live. You agree to use the App only for lawful purposes and in accordance with these Terms and applicable app store rules (Apple App Store, Google Play, as applicable).

You agree not to misuse the App, attempt to break or circumvent security (including any optional app lock), reverse engineer or scrape the App except where applicable law allows, or use the App in a way that infringes others’ rights or violates the law.

Your content

You retain ownership of photos, measurements, notes, and other content you enter in the App. You are responsible for the content you store and for any export or share you initiate. You represent that you have the rights needed for the content you add. We do not claim ownership of your personal progress data.

You are responsible for maintaining backups if you want copies beyond what remains on your device. Uninstalling the App may delete local data according to your device platform behavior.

Privacy

How the App handles permissions, local storage, and optional sharing is described in our Privacy Policy. By using the App, you acknowledge that you have reviewed that policy (or will review it) and that it forms part of your agreement with us where applicable.

License to you

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial use, in line with the applicable app store license terms.

Our intellectual property

The App, its name, branding, design, and underlying software are protected by intellectual property laws. Except for the limited license above, no rights are granted to you. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent except where mandatory law allows.

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

To the fullest extent permitted by applicable law, Bryan McNamara and his licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the App.

To the fullest extent permitted by applicable law, our total liability for any claim arising from these Terms or the App is limited to the greater of (a) the amount you paid us to use the App in the twelve (12) months before the claim (if any), or (b) zero (0) US dollars if the App was provided free of charge.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Bryan McNamara from claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

Changes

We may update the App or these Terms from time to time. Material changes will be reflected by updating the effective date on this page and, where appropriate, in-app notice or app store release notes. Continued use of the App after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires a different process.

Suspension & termination

You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App or any feature where we have a legitimate reason (for example, security, legal compliance, or end of support), to the extent permitted by applicable law and app store policies.

Governing law & disputes

These Terms are governed by applicable law without regard to conflict-of-law principles that would require applying another jurisdiction’s laws, except where consumer protection rules in your country require otherwise.

General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Failure to enforce a provision is not a waiver of our right to enforce it later. These Terms constitute the entire agreement between you and us regarding the App and supersede any prior understandings on the same subject.
